The 0.3% Delta-9 THC Threshold

The 0.3% delta-9 THC rule is a requirement set by the US government in order for a cannabis plant to be officially considered hemp. Delta-9 THC is the primary psychoactive component in cannabis that causes a “high.” Therefore, hemp plants must contain less than 0.3% delta-9 THC by dry weight in order to be considered hemp and legally cultivated in the United States.

The Details On Texas Law And Hemp-derived Delta-9 THC

Hemp and hemp-derived products must be tested according to Section 443.151 of the Texas Health and Safety Code throughout the manufacturing process. We’ve paraphrased key portions of the code below. The essential takeaways from the code state that:

According to subsection (b): Before a hemp plant can be used to make any kind of consumable product, lab technicians must first test it for things like:

-The concentration of various cannabinoids

-The presence or quantity of heavy metals and pesticides

-Any other substance that might be harmful

To put that in easier-to-understand terms, this means that any hemp you use for consumption has to be tested for the strength of any cannabinoids and for safety and purity.

As for subsection (c): Before material extracted from hemp through processing can be sold as a consumable hemp product, it must first pass a series of tests. These tests determine the presence of harmful microorganisms and residual solvents used in the processing (if applicable), among other substances. The executive commissioner decides what these tests will entail.

And for subsection (d) of the code: A sample of a consumable hemp product must be tested before it is sold at retail or introduced into commerce in this state unless the hemp product has been designated as exempt according to subsection (e).

  1. This product’s delta-9 tetrahydrocannabinol concentration must be tested by an accredited laboratory in line with the International Organization for Standardization ISO/IEC 17025 or comparable successor standard.
  2. The product must be tested by an authorized laboratory to ensure that it does not contain a substance included in subsection (b) or (c) at a quantity prohibited for those sections.

For hemp derived Delta 9 THC to be legal in Texas, the hemp plant must contain less than 0.3% Delta-9 THC by dry weight. In addition, the hemp plant must also be tested for any harmful compounds, and the final product must be thoroughly tested to ensure that it does not contain any prohibited substances.
